TERMS AND CONDITIONS
Definitions
“Freight” describes the cost incurred by a business for shipping raw materials or goods into their storage facility or production. It is a direct expense incurred as part of the business’ daily operation and recorded as a debit in the inventory records.
“Container” includes any container (including an open top container), flat rack, platform, trailer, transportable tank, pallet or any other similar article used to consolidate the Goods and any connected equipment.
“Goods” are tangible items that can be used and stored.
“Cargo Vessel” a large watercraft designed for transporting goods or materials from one location to another.
“Balikbayan box” is a corrugated box containing items sent by overseas Filipinos
“Terms and Conditions” means all terms, rights, defences, provisions, conditions, exceptions, limitations and liberties hereof.
1. Astra Zenith liability for loss, damage, or delayed box shall be as follows: (a) For lost or damaged shipments with NO DECLARED VALUE, liability shall only be limited to refund of freight fee, regardless of the actual content of the box. (b) For lost or damaged shipments with DECLARED VALUE, liability shall only be limited to the value declared in the Official Receipt or PACKING LIST, regardless of the actual/declared content of the box. (c) For delay in the delivery, customers may message the Astra Zenith Customer service for the status of the box/items.
2. Astra Zenith shall not be liable for loss, damage, or delay arising from act of nature, force majeure, acts of government authority, or shipper’s breach of this contract. Astra Zenith shall not be liable for moral and exemplary damages, and consequential damages, unless the amount of foreseen consequential damage is declared during the acceptance and higher freight fee is paid.
3. Shipper warrants the following: (a) All information is true and correct, particularly, names and addresses of shipper and consignee, as well as, the declared contents and value of the shipment. (b) The shipment contains no hazardous or prohibited items, e.g. explosives, flammable, firearms and parts, ammunition, illegal drugs, live animals, and all other items prohibited by law or common carriers, or requires government permit for its transport. (c) The consignee or any person of sufficient age and discretion will be at the given address to receive the shipment at the agreed day of delivery and shipment may be released to the latter in the absence of the consignee.
4. Shipper may check and verify the status of his/her box/items at customer care hotline, or Facebook page: https://www.facebook.com/ astrazenithcorp/ from Monday to Sunday between 9:00 AM – 5:00 PM, or track the box status at Astra zenith website. If undelivered, the status posted in the Track and Trace in the mentioned Astra Zenith website is deemed sufficient notice to the shipper and the latter must claim his shipment within thirty (30) days from acceptance, otherwise, Astra Zenith shall dispose the same in a manner it sees fit and apply the proceeds, if any, for storage fee from the date of posting of non-delivery until claimed or disposed. Unpaid Balikbayan boxes or items must include a maximum of 3 consecutive months. After the said months items will be disposed without the prior notice.
5. In case shipment is not delivered to the original consignee, delivery to a new address or return to sender as requested by the shipper shall be considered totally new transaction and corresponding freight fee shall apply. Changing of address and consignee details can be applied only when the box or items is still in the Astra Zenith warehouse and not already transferred to partner agents in Visayas and Mindanao areas.
6. Astra Zenith have no right to open a Balikbayan box, when the box is containing hazardous or prohibited items prior to acceptance in the presence of the shipper or authorized representative to ensure that shipment contains no hazardous or prohibited content. Astra Zenith reserves its right to refuse acceptance which, in its discretion, would be violative of its policies and pertinent laws.
7. Consignee or any person of sufficient age and discretion shall check the shipment upon receipt, shipment is deemed delivered and received in good order and condition in the absence of complaint or noted damage immediately communicated to Astra Zenith customer service.
8. If the box or item was damaged, consignee have the right to request an inventory of the Balikbayan box upon receiving. After this, the sender/consignee will report this through our customer service to take action on that matter. Any complaints on the boxes shall be reported immediately within 24 hours otherwise complaints will be no longer valid.
Restricted and Prohibited items.
To ensure the smooth delivery service of the company. Here is the list of prohibited items:
Firearms/Ammunitions: The company does not accept firearms, like guns, along with their ammunition (bullets or shells). This rule is in place to prevent potential danger and adhere to legal regulations.
Explosives/To Guns: Items that could explode or resemble guns are not allowed for transportation. This includes objects that could pose harm or be mistaken for dangerous weapons.
Precious Metals: Objects made from precious metals like gold, silver, or platinum are not included in their shipments. This is to prevent theft and protect valuable items.
Money Orders: Money orders, a form of payment, are not carried by Astra Zenith. This might be due to their specific handling requirements.
Traveler’s Checks: Similar to money orders, traveler’s checks, which offer secure payment, are also not part of their shipping services. This could be due to their sensitive nature.
Precious Stones: Items containing valuable gemstones like diamonds or rubies are not allowed for transportation. This rule prevents the risk of losing valuable items.
Drugs: Any form of drugs, both legal and illegal, are strictly prohibited. This is because shipping drugs is not being regulated by the local FDA and can have serious consequences.
Perishables: Astra Zenith does not accept perishable items, which are things that can easily spoil like food. These items are not suitable for long-distance shipping.
Negotiable Instruments in bearer form: This category includes various items like banned electrical devices, explicit materials, and gambling-related items. Astra Zenith refrain from transporting these items due to their nature or legal restrictions.
